Remember back at the end of 2016 when the Department of Labor proposed a new minimum salary level that was to used determine whether an employee could be considered exempt? As you may recall that salary level was set at $47,476 per year and was to take effect on December 1, 2016. As we all know that did not happen. Numerous parties sued to stop that change and a new administration came into office, thus eliminating the change. Yet a consensus was reached that said that perhaps the salary level needed to be addressed. Alex Acosta, the current Secretary of Labor has suggested a level of $33,000 per year, but rather than just instituting that change he has called for public input.
Public Listening session
The U.S. Department of Labor’s Wage and Hour Division announced on August 27th that in the upcoming weeks it will hold public listening sessions to gather views on The Part 541 white-collar exemption regulations, often referred to as the “Overtime Rule.” These public hearings will be held in venues across the country and anyone can attend, you just have to register on Eventbrite here.
