Ah yes, the incessant mantra of all HR departments. Document, document, document until you are tired of hearing about it. However, I attended a legal session yesterday that emphasized the importance of documentation.
The lesson
The legal session I attended was put on by Drew Eckl & Farnham, LLP and dealt with the intersection of Workers’ Comp, the ADA and FMLA. It was a very informative session that showed what a nightmare the intersection can be. Three laws not really made to go together but by practice potentially converging in many, many cases. There will be a post on this next week. However, the one very important lesson from these attorneys was the IMPORTANCE OF DOCUMENTATION in protecting the company. This documentation is not just reports and medical certification, but includes the reasons you made the decisions you did. This is important because even if you are found by a judge and jury to have made an improper decision the fact that you were able to document your decision making process may lessen the damage you have to deal with.
